New Jersey Couple Settled in Texting While Driving Case

Even with all of the statistics that reveal the dangers of texting while driving, it is estimated that at any given time there are about 800,000 people who text while operating their vehicle. It is also estimated that 25% of all car accidents are the result of the driver texting.

A couple, formerly from Dover, New Jersey, received $500,000 settlement for the motorcycle accident lawsuit they filed in 2009. David and Linda Kubert, who now live in Florida, lost one leg each when the motorcycle they were riding was hit by Kyle Best who was 19 at that time the accident happened on September 21, 2009. Kyle Best was found to be texting while driving when his vehicle rammed into the couple’s motorcycle.

Best’s vehicle insurance paid for the cash settlement, which is also the maximum insurance policy limit. Motorcycle accident lawyer Stephen Weinstein who helped the Kubert’s with the lawsuit said that Linda Kubert hasn’t reported back to work since losing her left leg while David Kubert can no longer work because his left leg was amputated above the knee.

Kyle Best pleaded guilty and admitted to texting his girlfriend while driving at the time of the accident. There were also records shown at the trial wherein Best was found to be communicating with his girlfriend prior to calling for help. While Best wasn’t criminally prosecuted because he pleaded guilty, as part of his sentence, he must speak to fourteen high schools about the perils of texting while driving. He was also ordered to pay fines amounting to $775. His driver’s license, however, was not revoked.
