ZDR Settles Federal Tort Claim

The attorneys at Zevan Davidson Roman recently settled a federal tort claim involving a veteran who lost his leg while receiving treatment at a Veterans Affairs hospital in St. Louis. 

 

Case Background

We filed this case on behalf of a veteran who visited the hospital with pain in his left foot. After an exam and routine imaging, his physician determined that the pain was due to a minor puncture wound. His foot was cleaned and bandaged and the man was sent home. 

Six days later, he returned to the emergency room with severe pain. Once admitted to the hospital, it was discovered that a wooden toothpick was lodged inside his foot. Despite aggressive treatment, the man was forced to undergo an amputation of his left leg below the knee. 

 

Failure to Diagnose Settlement

Our attorneys alleged that the man’s physician failed to exercise proper care and skill during our client’s initial visit. Not only did the physician fail to recognize that wooden objects are often missed during plain film x-rays, but also they failed to consider the man’s pre-existing conditions when evaluating his pain and symptoms. 

After preparing this case for trial, we reached an agreeable settlement with the federal government. Our client now has the funds to cover his ongoing medical care as well as offset some of the pain and suffering he has endured since the incident.
